TERMS OF SERVICE
LAST UPDATE: [11/04/2024]Be aware that my prices and TOS are subject to change at any given time, so please take the time to read them thoroughly and check back for updates anytime you plan to commission me to avoid any misunderstandings. I will post whenever I update my TOS on my active social media pages, as well as change the last updated date on this form.GENERAL RULES AND INFORMATION
• I have the right to turn down a commission for any reason if I am not comfortable. Unless I voice I am not able to take it on for personal reasons other than being uncomfortable, I am open to negotiation, but do not disrespect my boundaries otherwise.• All prices listed are base prices, meaning they are subjected to increase, depending on what exactly you're looking for in your commission.
The price of a commission may increase if you have a complex design character (very detail heavy character/outfit/etc, extra limbs, wings, etc.), detailed backgrounds, etc.• You must be an adult (18+) in order to request any graphic commission. This includes suggestive content and gore.• Please provide me with as many references and details you would like included in your commission. Do not worry about being too demanding or specific, I want to be able to fully satisfy you with the finished piece!
I will not take only a written description of a character as a “reference” (this doesn't apply for custom designs).• If for some reason I make a mistake that was completely my fault in the final piece (ex: forgot a certain detail requested or character trait that was included in the provided reference(s)), I will fix it with no extra charge. However if the mistake is on you (providing an outdated reference sheet, failing to clarify said detail in the commission form) it will either remain unchanged, or require an additional cost to fix.PAYMENT AND PROCESS
• The only method of payment I accept is USD through Paypal. I will not accept payment through in-game currencies, trading characters, etc. Unless I publicly promote an offer like this on my social media, please do not bother negotiating otherwise, the answer will be no.• I take 100% payment upfront. I will start once I receive payment.
However, in the case that my queue is full, I will add you to a waitlist. You do not have to send payment while you are on a waitlist. I will only ask for it once a slot opens up and I accept your commission. Please make sure you still have payment ready for whenever I reach out. I can hold a slot for 48 hours maximum - but if you fail to pay on time, I will remove you from the waitlist and move on to the next client. Doing this multiple times will result in a blacklist.• I will open a limited amount of slots, which will close and open as I complete commissions. If a slot opens you may reserve it for 48 hours. If I do not receive payment, it will be given to the next person waiting.• Refunds requested by the commissioner can only be granted if I have not gone past the final sketch phase. Anytime after if the commissioner requests to be refunded, I will not be able to. I will still complete the commission.
If I am unable to complete a commission due to matters on my own end, regardless of what stage I am at in the process, a full refund will be issued.
^{I as the artist have the right to drop your commission at any given point for any reason, and I will issue a 100% refund if so.}• Please be aware that any commission that includes a base price only indicates the starting cost of that commission. Depending on details requested, character and background complexity, etc., the final price is subject to increase.• Commissions may take anywhere from a few days to up to a month to complete, depending on my queue, how time consuming the commission is, personal matters, and other work I have. All I ask is that you remain respectful and civil. I am okay with you asking about progress updates, but please do not pressure me or be rude, as I can drop your commission (with full refund) at any time.• I will provide updates as regularly as I make any progress to make sure you are satisfied with the piece. You are more than welcome to ask for updates if I am taking longer than expected, and I will inform the commissioner if I am to experience any delays.• In the beginning sketch phase, I will provide a concept(s) sketch to make sure you are happy with the composition.• From any point during the process, you are welcome to critique and request changes to the commission as I work on it. I want to make sure you’re satisfied with the final result :)• I would be most comfortable keeping in contact either on Instagram or Discord, as those are the two platforms I check regularly and can guarantee a faster response.
If none of those are viable for you, I am willing to compromise.COPYRIGHT
• As the artist I will always have full rights to the artwork itself that I created. I will never claim rights to any characters used within my commissioned artworks.• I am allowed to use the artwork itself on my social media pages, to advertise my commissions, and promote myself.• As the commissioner, you are allowed to use your commissioned artwork for personal and non-commercial use (avatars, wallpaper, banners, etc). You may also have the piece printed as posters, send it to other companies to put on shirts, accessories, etc. but ONLY if it is for PERSONAL use!• You cannot use my art to use as or sell as NFTs, or to train any AI model. If I catch you doing this, you will be BLOCKED and BLACKLISTED.• If you happen to sell the character in the commissioned piece it is to be passed down to the buyer without any charge. You cannot sell the piece itself.• You are allowed to sell a custom designed character if the original design was made by me. You must sell the character’s commissioned design that I made for the same price you paid. This only applies to the work by me, any additional art pieces this character may have made by yourself or other artists are up to you to decide how much the character will sell for. Please remember to contact me so that I know who the new owner will be!• If you post the commissioned work anywhere public you must provide proper credit to me (i.e., art by overwhelve — don’t try to hide my credit or anything) and not claim it as your own.• I do not offer an extra fee in order to obtain full commercial rights to the commissioned work.If you have any questions or concerns, please do not be afraid to ask!

EXTRA CHARACTERS = 75% OF BASE PRICE OF CHOSEN COMMISSION TYPE EACH.

Characters with detail heavy designs (multitude of accessories, extra limbs, wings, complex markings, etc.) I will increase the price for. NOTICE: at this time I am accepting Animal Jam Classic items and Marvel Rivals skins as payment for commissions. If you would like to pay this way, DM me that you're interested and we will discuss payment!
